THE ESCAPE TO TAHITI SWEEPSTAKES (“SWEEPSTAKES”) IS INTENDED FOR PLAY IN THE FIFTY UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY (COLLECTIVELY, THE "ELGIBILITY AREA") AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN, AND A LEGAL RESIDENT OF, THE ELIGIBILITY AREA.

WINNER AND TRAVEL COMPANION WILL BE REQUIRED TO TRAVEL TO LOS ANGELES INTERNATIONAL AIRPORT AT THEIR SOLE EXPENSE TO TAKE THE TRIP PRIZE. ALL TRAVEL FOR THE TRIP PRIZE MUST BE COMPLETED BY JULY 31, 2009 OR PRIZE WILL BE FORFEITED.

ENTRY IN THIS SWEEPSTAKES CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

1. Eligibility: To participate in the Sweepstakes, you must be a legal resident of the Eligibility Area and 21 years or older at the time of entry. Void in overseas U.S. territories, possessions, commonwealths and military installations, and where prohibited by law. Employees, officers, directors, and agents of Yahoo! Inc. (“Sponsor”), CDM Travel Service, Tahiti Legends, their respective affiliates, parents, subsidiaries, advertising and promotional agencies, any other prize Sponsor, and any entity involved in the development, production, implementation, administration or fulfillment of the Sweepstakes (all of the foregoing, together with Sponsor, collectively referred to as “Promotion Entities”), and the immediate family members and persons living in the same household as such individuals, whether related or not, are not eligible to participate or win. For the purpose of this Sweepstakes, immediate family members are defined as spouse, parent, in-law, grandparent, sibling, child and grandchild.

2. How To Enter: The Sweepstakes begins at 12:01 AM PT on May 21, 2008 and ends at 5:00 PM PT on July 14, 2008 (the “Entry Period”). The Web Site’s (defined below) database clock will be the official timekeeper of this Sweepstakes. You may enter the Sweepstakes in ONE of two ways:

   a. Online Entry: To enter online, complete and submit the official entry form (“Online Entry”), which is located at http://hotjobs.promotions.yahoo.com/tahiti. You will be asked to provide your first and last name, physical mailing address (no post office boxes), telephone number, and email address. You may also be asked to answer optional questions; however, they need not be answered in order to be eligible for the Sweepstakes. All Online Entries must be received by 5:00 PM PT on the last day of the Entry Period.

   For purposes of this Sweepstakes, “receipt” of an Online Entry occurs when Yahoo!’s servers record the entry information upon clicking the “Submit Entry” button. In the event of a dispute about the identity of an online entrant, each Online Entry will be declared made by the authorized email account holder of the email address submitted at the time of entry. “Authorized email account holder” is defined as the natural person who is assigned to an email address by an internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the winning entry. If a dispute cannot be resolved to the Sponsor’s satisfaction, the entry will be deemed ineligible.

   b. Mail-In Entry: To enter by regular postal mail, send a postcard on which you have hand-printed your first and last name, physical mailing address (no post office boxes), telephone number, and email address (if available) to: Escape to Tahiti Sweepstakes, Mail-In Entries, PO Box 3382, Dept.10, St. Cloud, MN 56397-3382. All mail-in entries must be postmarked by the last day of the Entry Period and received no more than seven calendar days later.

   The following applies to both methods of entry: LIMIT ONE (1) ENTRY PER PERSON, REGARDLESS OF MEANS OF ENTRY. Although subsequent attempts to enter may be received, only the first entry received from a particular individual will count; subsequent attempts to enter will be disqualified. The submission of an entry is solely the responsibility of the entrant. Entries may only be made according to the methods described above. Proof of sending (such as an automated computer receipt confirming delivery of email, "thanks for entering" message or post office receipt) does not constitute proof of actual receipt by Sponsor of an entry for purposes of this Sweepstakes. Automated entries (including but not limited to entries submitted using any bot, script, macro, or sweepstakes service), copies, third party entries, facsimiles, mechanical reproductions, and/or entries made by anyone other than the entrant and/or originating at any other website, are not permitted and will be disqualified. Only eligible entries actually received by Sponsor before the end of the specified Entry Period will be included in the prize drawing. Illegible, unintelligible, incomplete, garbled, lost, late, misdirected, forged, altered, mutilated, or postage-due entries will be disqualified. All entries become the property of Sponsor, and none will be acknowledged or returned.

3. Conduct: By entering the Sweepstakes, entrants agree to comply with and be bound by these Official Rules. The Official Rules will be posted at the Sweepstakes Website throughout the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Entrants further agree to comply with and be bound by the decisions of the Sponsor’s designated judges, which will be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual found to be: (a) tampering or attempting to tamper with, impair, damage, or interrupt the entry process or the administration, security, fairness, proper play, or operation of the Sweepstakes or any Yahoo! website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Yahoo! property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any person who supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize will forfeit any prize won and may be prosecuted to the full extent of the law. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

4. Prize

   Prize: One (1) winner will receive a trip for two (2) (winner and companion) to Tahiti, Moorea and Bora Bora (“Prize”), provided by Tahiti Legends. Prize package includes round trip coach class air transportation for two from the Los Angeles International Airport (“LAX”) (carrier and destination airport to be selected by Sponsor) to Tahiti; hotel accommodations (one room, standard, double occupancy) for 2 nights in Tahiti, 3 nights in Moorea, 3 nights on Bora Bora; Welcome flower lei meeting service upon arrival; Shark & ray snorkel safari on Bora Bora; 4x4 jeep safari on Moorea; all transfers and baggage handling; Inter-island air on Air Tahiti; Room tax and VAT. Approximate retail value of Prize: $11,000 (Prize value may vary depending upon the actual cost of air transportation from point of departure and accommodations at time of reservation). All prize details and specific arrangements not specifically stated will be made in Sponsor’s sole discretion.

   Except as specifically provided herein, Prize does not include taxes, insurance, telephone charges, personal expenses, travel arrangements between winner’s home and LAX, ground transportation, gratuities, passenger facility charges (PFCs), departure taxes, incidental charges, in-room charges, or any other item not specifically described in these Official Rules, and all expenses for any of the foregoing are the sole responsibility of the Prize winner. Winner may be required to provide a credit card to cover incidentals and related expenses at the time of each hotel check-in. Prize winner and travel companion must each have a valid passport at the time of travel and provide copies of valid passports to comply with foreign government regulations. At Sponsor or Sponsor’s representative’s request, winner will be required to choose and inform Sponsor’s representative of three desired departure dates, in order of preference, and will be notified of confirmation within 30 days of travel. Once confirmed, trip dates and travel accommodations cannot be changed by winner; however, travel is subject to availability, blackout dates, and/or change due to circumstances beyond Promotion Entities' control. Promotion Entities are not responsible or liable if trip Prize cannot be scheduled to begin on one of the three dates selected by winner. Winner and travel companion must travel on the same dates, itinerary, and fare class. Travel must originate from and end at LAX. Flight schedules are subject to change without notice. Promotion Entities are not liable for any expenses incurred as a consequence of flight cancellation/delay. All travel awarded in this Sweepstakes must be completed by July 31, 2009. Failure to complete the trip Prize does not relieve the Prize winner of his or her tax obligations associated with winning the Prize. No extensions will be permitted, and any unused travel or portion of the Prize will be forfeited and no compensation awarded in lieu thereof. If the winner does not accept or use a portion of the Prize, the unaccepted or unused portion of the Prize will be forfeited and the Promotion Entities will have no further obligations with respect to that portion of Prize. Prize cannot be used in conjunction with any other promotion or offer and may not be separated. All tickets issued in conjunction with the Prize are not eligible for frequent flyer miles, and no code-share flights may be used. Prize may not be transferred or assigned except by Sponsor. Only the listed Prize will be awarded and no substitutions, cash equivalents or redemptions will be made, except that Sponsor reserves the right to substitute the Prize or any portion thereof with another Prize or portion thereof of equal or greater value for any reason, including, without limitation, in the event that the advertised Prize (or any component thereof) is not available. Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from, acceptance or use of the Prize, are the sole responsibility of the Prize winner. Sponsor and Yahoo! expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the Prize or any portion thereof awarded. Sponsor and Yahoo! make no representations or warranties concerning the appearance, safety or performance of the Prize or any portion thereof. WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. Restrictions, conditions, and limitations apply. Promotion Entities will not replace any lost or stolen prize or other items. The Prize, if legitimately claimed, will be awarded.

5. Winner Selection and Notification/Odds: Potential winner will be selected in a random drawing to be held on or about July 20, 2008, from among all eligible entries received. Odds of winning depend on the number of eligible entries received. The Prize drawing will be conducted by judges selected in Sponsor’s sole discretion, whose decisions are final. Winner must be twenty-one (21) years of age at the time of entry to be eligible. Travel companion must be twenty-one (21) years of age or older at the time trip is taken in order to accompany winner on the trip Prize.

   Potential winner will be notified within seven (7) days after drawing date via email, U.S. mail, telephone and/or by overnight courier (in Sponsor’s sole discretion). Prize winner and travel companion may be required to sign, notarize and return an Affidavit of Eligibility and Liability/Publicity Release and provide any additional information (such as social security number) that may be required by Promotion Entities, except where prohibited by law. Except where prohibited by law, potential winner must return all required documents (together with travel companion’s required documents) within fourteen (14) days following Sponsor’s first attempted notification or prize may be forfeited. All Affidavits of Eligibility and Liability/Publicity Releases are subject to verification by Sponsor. Rejection, faultiness, or return as undeliverable of any prize/prize notification, or inability of Sponsor to contact a potential winner after a reasonable attempt has been made (determined in Sponsor’s sole discretion), may result in disqualification and selection of an alternate winner by random drawing. If applicable, winner may be issued an IRS Form 1099 which documents the value of the prize for tax purposes. Any difference between actual value of Prize at the time of award and the approximate retail value of the Prize as stated in these Official Rules will not be awarded.

6. General Conditions:

   By entering, participants: (a) agree to release, indemnify, defend, and hold harmless Promotion Entities from any and all liability whatsoever for any injuries, loss or damage of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, award, or use of any prize, or while participating in , traveling to, and/or preparing for any Sweepstakes- or Prize-related activity, and (b), except where prohibited by law, grant to Sponsor the right to use and publish their proper name and state online and in print, or any other media, in connection with the Sweepstakes. By entering this Sweepstakes and accepting a prize, the winner agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Sweepstakes-related activity, including use of the trip Prize. The winner understands and agrees that Sponsor has the right, in its sole discretion, to disqualify and remove the winner or his or her travel companion from any activity at any time if the winner’s or his or her travel companion’s behavior at any point is disruptive or may or does cause damage to person, property, or the reputation of the Promotion Entities or otherwise violates the policies of the prize providers. NO RESPONSIBILITIES ARE ACCEPTED BY THE PROMOTION ENTITIES FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR CANCELLATIONS RESULTING FROM ANY ACTS OF ANY GOVERNMENT OR AUTHORITY. THE PRIZE WINNER ACKNOWLEDGES THAT HE/SHE IS SOLELY RESPONSIBLE FOR ANY ACTIONS, CLAIMS OR LIABILITIES OF HIS/HER TRAVEL COMPANION RELATED TO ANY SWEEPSTAKES ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY ACTIONS, CLAIMS OR LIABILITIES RELATED TO THE TRAVEL COMPANION’S USE OF THE PRIZE OR ANY PORTION THEREOF.

   Except where prohibited by law, a winner’s acceptance of a Prize constitutes permission for Promotion Entities to use such winner’s name, address (city and state only), statements, photograph, voice, likeness, biographical data, and/or any information contained in his/her entry for any advertising or promotional purposes relating to the Sweepstakes without further compensation, consideration, notice, review or consent.

7. Limitations of Liability: Promotion Entities assume no responsibility and are not liable for lost, late, misdirected, illegible, incomplete, or mutilated entries, postage-due mail, or for theft, destruction or unauthorized access to, or alteration of, entries. Promotion Entities are not responsible for any incorrect or inaccurate information, including errors or typos in these Official Rules or any Sweepstakes-related communication or material, whether caused by a Promotion Entity, website users, any of the equipment or programming associated with or utilized in the Sweepstakes, or any technical or human error. Promotion Entities assume no responsibility and are not liable for any failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or entry information, any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing. Promotion Entities are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Promotion Entities which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes.

8. Disputes/Governing Law: Except where prohibited, as a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes that cannot be resolved between the entrant and any Promotion Entity, claims and causes of action arising out of or connected with this Sweepstakes, or the Prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-pocket expenses (e.g., costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.

   All disputes between a participant and any Promotion Entity in connection with this Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to the conflict of laws rules thereof and any matters or proceedings which are not subject to arbitration as set forth in these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of California, County of Santa Clara.

   The parties waive rights to trial by jury in any action or proceeding instituted in connection with these Official Rules and/or this Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or this Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of California, County of Santa Clara, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
